ECI row explained: why the CEC faces a Supreme Court hearing

The Election Commission of India is at the centre of a constitutional storm. Here is what the row is about.

The petitioners say Article 324 of the Constitution gives the power to run elections to the commission as a multi-member body, not to its chairman alone. A 2023 law requires decisions to be taken collectively, by unanimity or by majority.

They claim Chief Election Commissioner Gyanesh Kumar took at least 14 decisions in the commission’s name without the agreement of the other two commissioners, Sukhbir Singh Sandhu and Vivek Joshi, who recorded written objections between October 2025 and August 2026.

The disputed steps relate to the Special Intensive Revision of voter rolls, including changes to Form 6 and access to electoral roll databases. One petition seeks Kumar’s suspension; another wants a judicial inquiry.

The Supreme Court hears the matter today. If it finds merit, the ruling could reshape how the poll body functions.
