SC Won’t Suspend CEC, Says Poll Body Decisions Need Majority

The Supreme Court on Monday refused to suspend Chief Election Commissioner Gyanesh Kumar. But it said the Election Commission must take its decisions unanimously or by majority.

A bench led by Chief Justice of India Surya Kant heard a plea seeking Kumar’s suspension. The plea said he had taken key decisions on the Special Intensive Revision (SIR) of voter rolls without the agreement of the two other Election Commissioners, Vivek Joshi and Sukhbir Singh Sandhu.

The court issued notices to the Election Commission and the Union government. Both must reply within a week. The judges said that if any decision was found to have been taken without unanimity, the court could reconsider or recall it.

“Let’s be very clear. Any modified Form Six has not been approved by us,” the Chief Justice said. The remark came amid a row over changes to the voter registration form.

The poll body has said its final decisions on the SIR schedule were unanimous. The court will examine the records after the responses come in.
