CJI To Examine Plea On Election Commissioners’ Appointment Law

The Supreme Court on Wednesday agreed to examine a plea seeking recall of its September 23 split verdict on the law governing Election Commissioner appointments.
Senior advocate Gopal Sankaranarayanan mentioned the application before Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V Mohana.
“We will examine and then take a call,” the Chief Justice said.
The plea was filed over an apprehension of bias against Justice Satish Chandra Sharma. It emerged that his son is standing counsel for the Election Commission before the Madhya Pradesh High Court.
Justice Sharma was part of the bench that delivered the split verdict with Justice Dipankar Datta.
The September 23 verdict concerned the 2023 law on the appointment of the Chief Election Commissioner and Election Commissioners. The two judges differed on whether the challenge should go to a Constitution Bench.
Justice Datta said no larger bench was needed. Justice Sharma favoured a reference.
The counsel also told the court that a curative petition has been filed against the split verdict.
