CJI to examine plea seeking recall of CEC law verdict

Chief Justice of India Surya Kant said on 7 October that he will examine an application seeking recall of the Supreme Court's 23 September split verdict.
We will examine and then take a call, he said.
The application was mentioned by senior advocate Gopal Sankaranarayanan. It was filed by Naman Shrestra as an interlocutory application.
The plea alleges reasonable apprehension of bias.
It says Justice Satish Chandra Sharma, who was part of the split-verdict bench, did not disclose that his son is a standing counsel for the Election Commission of India.
The 23 September verdict saw Justices Dipankar Datta and Satish Chandra Sharma differ. They differed on whether challenges to the 2023 CEC appointment law should go to a larger bench.
The matter has been referred to a five-judge bench before the CJI.
Sankaranarayanan told the court that another party had filed a curative petition against the split verdict.
The CJI noted that a curative petition must be preceded by a review.
The recall plea was earlier mentioned before Justice Datta. He asked for it to be mentioned before the CJI after case records were returned.
