What is a countervailing duty? India’s China sulphur probe

India has opened a countervailing duty (CVD) investigation into imports of insoluble sulphur from China. The term sounds technical, but the idea is simple: a CVD is a tariff imposed to cancel out the advantage of foreign government subsidies.

When a country subsidises its exporters through cheap loans, tax breaks or discounted land and power, those exporters can sell below fair prices in other markets. This can injure domestic producers. A countervailing duty adds a levy equal to the subsidy margin, levelling the playing field.

CVDs are permitted under World Trade Organization rules. They differ from anti-dumping duties, which target companies selling below cost, while CVDs target government subsidies behind the pricing.

In the sulphur case, petitioner OCCL Limited, India’s sole domestic producer, has listed 79 subsidy programmes allegedly extended by Chinese authorities. The DGTR’s probe will assess whether subsidies exist and whether they injured Indian producers. Any duty would follow the authority’s findings and a final decision by the finance ministry.
