Supreme Court Refuses to Unfreeze TMC’s Bank Accounts

The Supreme Court on Thursday dismissed a plea by the Mamata Banerjee-led Trinamool Congress faction to operate four debit-frozen bank accounts. A bench of Justices M.M. Sundresh and P.B. Varale said it was not inclined to interfere.

The court declined to exercise its jurisdiction under Article 136. It noted that the Election Commission has frozen the party symbol, so the larger question of who is entitled to the funds is pending adjudication.

The bench asked the Calcutta High Court to expedite its hearing. The high court had on August 27 refused interim relief to operate the accounts, which hold around 804 crore rupees.

The accounts were debit-frozen by West Bengal Police. The TMC faction claimed there were lacunae in the FIRs behind the freezing.

Senior advocate Abhishek Manu Singhvi argued the freeze had paralysed the party’s functioning. The Supreme Court said it would refrain from going into the merits.

The case will now return to the Calcutta High Court for an expedited hearing.
