SC Backs HC Order Quashing 34% BC Quota in Andhra Pradesh

The Supreme Court on Friday dismissed the Andhra Pradesh government’s plea on the 34 per cent Backward Classes quota. The quota was for local body elections.
A bench of Justices Dipankar Datta and Sheel Nagu upheld the High Court’s order. The High Court had quashed two government orders providing 34 per cent reservation to BCs.
The court said the total reservation would cross the 50 per cent ceiling. This ceiling comes from the 1992 Indra Sawhney judgment. The state had relied on a Unified Family Survey to fix the quota. The court questioned the survey’s legal basis.
Senior Advocate Mukul Rohatgi argued for the state. Justice Datta said the High Court took a very reasonable approach.
Chief Minister N Chandrababu Naidu said the NDA would still give 34 per cent of tickets to BCs in the local body polls. He said BCs are the backbone of the TDP.
The polls are expected in November. The government will now go ahead with the standard quota process.
