Supreme Court to examine plea to recall split verdict on CEC law

The Supreme Court on October 7 agreed to examine a plea to recall its September 23 split verdict. The verdict dealt with the 2023 law on appointing the Chief Election Commissioner. Chief Justice Surya Kant said the court would look into the request.
The split verdict came from Justices Dipankar Datta and Satish Chandra Sharma. They differed on whether the challenge to the law should go to a larger Constitution bench. The split left the issue unresolved.
The recall plea raises a bias allegation against Justice Sharma. It says his son is a standing counsel for the Election Commission of India. The plea argues this affected the case. A curative petition has also been filed in the matter.
CJI Surya Kant told the petitioners, “We will examine and take a call.” The 2023 law changed how the CEC and Election Commissioners are appointed. Opposition parties have challenged it as a threat to the poll body’s independence.
