Nigeria’s African Action Congress has filed a suit at the Federal High Court accusing President Bola Tinubu of failing to formally transfer power or notify the National Assembly during his extended stay in Europe.

The party argues that the prolonged absence without a proper handover breaches constitutional requirements and has left governance questions unanswered. It wants the court to determine whether the president’s actions violated the law.

The presidency has not publicly responded to the filing. Tinubu’s recent trips abroad have drawn criticism from opposition figures, who say Nigerians deserve clarity on who is in charge during long absences.

Legal observers say the case will test how strictly Nigerian courts interpret constitutional provisions on presidential absence and the transfer of executive authority. Proceedings are expected to begin in the coming weeks.

Tinubu, who took office in May 2023, has undertaken frequent foreign trips for summits and medical check-ups, each time drawing opposition scrutiny. Past Nigerian presidents have faced similar legal challenges over absences, and courts have generally been cautious about ruling on what they deem political questions.
