Supreme Court to hear plea against CEC Gyanesh Kumar today

The Supreme Court will hear petitions today challenging whether Chief Election Commissioner Gyanesh Kumar can exercise powers that belong to the multi-member Election Commission.

A bench led by Chief Justice Surya Kant, with Justices Joymalya Bagchi and V Mohana, will take up two writ petitions over decisions linked to the Special Intensive Revision of voter rolls.

The petitions claim at least 14 decisions were taken in the name of the commission without the agreement of the other two election commissioners, Sukhbir Singh Sandhu and Vivek Joshi. The commissioners are said to have recorded written objections between October 2025 and August 2026.

The petitioners argue that Article 324 of the Constitution vests election powers in the commission as a body, and that the 2023 law requires collective decision-making by unanimity or majority. One petition seeks Kumar’s suspension; the other wants a judicial inquiry into the disputed decisions.

The court has made no finding on the merits so far. The hearing will decide whether the challenge proceeds.
