The Supreme Court on Monday dismissed a petition asking the court to declare that Subhas Chandra Bose's Indian National Army actually won India's independence from British rule, Bar and Bench reported.

A bench of Chief Justice Surya Kant and Justice Joymalya Bagchi refused to entertain the plea filed by petitioner Pinakpani Mohanty. The court pointed out that a similar plea had been dismissed earlier, and warned the petitioner that he could be barred from approaching the court for filing frivolous petitions.

"It seems to us that the petitioner indulges in such activities for popularity. The factual issues cannot be determined on the judicial side," the bench said, according to the report.

The petition had also sought directions to declare October 21, 1943 — the INA's foundation day — as a national day, to honour Bose's birthplace in Cuttack with a national museum, and to declassify records on how the British left India.

The court has turned down similar pleas by the same petitioner before, including one in April this year seeking 'National Son' status for Bose, for which the registry was asked not to entertain repeat filings.
