Woman Shot 5 Times by Agent Sues US Government

A Chicago woman shot five times by a Border Patrol agent has sued the US government. She says the shooting was unjustified.
Marimar Martinez, 30, filed the lawsuit on Monday in federal court in Chicago. It comes almost exactly a year after Border Patrol agent Charles Exum shot her on Oct. 4, 2025, during Operation Midway Blitz, the immigration enforcement surge in Chicago.
Federal officials first claimed Martinez tried to ram agents with her car. Her lawyers say a forensic reconstruction shows Exum was beside the vehicle, not in front of it, when he fired. The five shots left her with seven wounds. Prosecutors later dropped all charges against her. A judge dismissed them with prejudice in November 2025, so they cannot be refiled.
The suit, filed under the Federal Tort Claims Act, accuses the government of negligence, battery, assault, false arrest and malicious prosecution. Her lawyers also urged prosecutors to bring criminal charges against Exum.
The Department of Homeland Security said Exum was placed on administrative leave. The Justice Department declined to comment on the case.
Martinez, a teaching aide at a Montessori school, said she wants justice for other victims of the operation too.
