Comedian Kunal Kamra has moved the Supreme Court seeking to intervene in the seven-judge bench reference on the scope of legislative privileges under Article 194(3) of the Constitution. Kamra’s application argues that the fundamental right to free speech under Article 19(1)(a) cannot be made to yield to unfettered legislative privilege.

His plea relates to pending privilege proceedings initiated by the Maharashtra Legislature over his satirical performance titled Naya Bharat. The seven-judge reference is examining the limits of the powers, privileges and immunities of state legislatures and their members.

Kamra has contended that satire and political commentary are core to democratic discourse and that privilege proceedings must not be used to silence dissent. The Supreme Court is scheduled to hear the matter from 6 October 2026. The intervention application adds a high-profile voice to a case that could define the balance between parliamentary privilege and free expression in India for years to come.
